SERVICES PROVIDED

  • The Competition Commission is required to investigate alleged contraventions of Chapter 2 of the Competition Act.
  • Chapter 2  deals with restrictive horizontal and vertical practices and the abuse of dominance.
  • The Commission must investigate all complaints and may initiate a complaint in cases where a reasonable suspicion of an alleged contravention exists.

  • Complaints should be lodged with the Commission using a CC 1 Complaint Form. The complaints form is available on the website:
    http://www.compcom.co.za/forms.asp
  • A case number is allocated to the complaint and serves as ‘proof’ to the complainant that the complaint has been received.
  • The case is then referred to an investigator who will investigate the alleged contravention of the Competition Act.

  • The Competition Commission is independent, but its decisions may be appealed to Competition Tribunal and the Competition Appeal Court.
  • The Commissioner is accountable to the Department of Trade and Industry and Parliament.

POWERS

  • The Commission may investigate and monitor the conduct of a person.
  • However, one is under no obligation to justify one's conduct to the Commission.
  • Advisory opinions are not binding on consumers. A complainant can appeal against a decision of the Competition Commission to the Competition Tribunal and the Competition Appeal Court

  • A complainant can appeal against a decision of the Competition Commission to the Competition Tribunal and the Competition Appeal Court.
  • Any person who is not satisfied with the service offered by the Commission in respect of advisory opinions and related services can forward their concerns to:

The Competition Commission provides basic training on merger analysis, exemptions and filing of complaints to consumer organisations at no cost and will meet with any organisation wanting to participate in a particular case, in order to provide guidance and assistance.
